Livera Gifts Enterprise, a business registered in Malaysia (“Livera Gifts”, “we”, “our” or “us”), provides this website https://liveragifts.com (“Website”) and all products and services subject to the Terms and Conditions below.

By accessing this Website, creating an account, placing an order, requesting a quotation, submitting artwork, or purchasing any products or services from Livera Gifts, you agree to be bound by these Terms and Conditions. If you do not agree, please discontinue use of the Website and do not proceed with any order.

1. Customer Account Registration

The Website may be browsed without creating an account. However, account registration may be required for certain purchases, enquiries, wallet usage, order tracking, or other services.

By registering an account, you agree to provide true, accurate, current, and complete information. You are responsible for keeping your account login details secure and for all orders or activities made under your account.

You must be 18 years old or above to create an account. If you are below 18 years old, you must obtain consent from your parent or legal guardian.

If you register on behalf of a company, business, association, or other legal entity, you confirm that you have the authority to act on behalf of that entity.

Livera Gifts reserves the right to suspend or terminate any account if the information provided is false, incomplete, misleading, or if we suspect misuse of the account.


2. Orders and Payment

All products and services are subject to availability. Livera Gifts reserves the right to accept, reject, cancel, or amend any order at our discretion.

An order is only considered confirmed after payment has been received and/or written confirmation has been issued by Livera Gifts.

We may accept payment methods including but not limited to online banking, bank transfer, wallet payment, payment gateway, or any other method made available on the Website.

For bank transfer or manual payment, orders will only be processed after payment has cleared and proof of payment has been verified.

Ownership of products will only transfer to the customer after full payment has been received.

Prices displayed on the Website are in Malaysian Ringgit (RM). Prices may be changed at any time without prior notice.


3. Promotions, Discounts and Price Errors

Livera Gifts may offer promotions, discounts, vouchers, wallet rewards, or special pricing from time to time.

We reserve the right to cancel, amend, or reject any promotion, coupon, discount, or wrongly displayed price at any time.

If a product price is incorrectly displayed due to technical error, typographical error, system issue, or other mistake, Livera Gifts reserves the right to cancel or amend the affected order.


4. Custom Printing, Artwork and Design

For custom printed products, customers are responsible for providing accurate artwork, logos, text, colours, sizes, and printing instructions.

Customers must ensure that any artwork, logo, image, brand name, trademark, or content submitted to Livera Gifts is owned by them or legally authorised for use.

Livera Gifts will not be responsible for any copyright, trademark, intellectual property, or legal claims arising from artwork or content provided by the customer.

Where design service is provided, customers are required to check and approve the final design before production. Once artwork or design is approved, Livera Gifts will not be responsible for any spelling mistakes, grammar errors, wrong information, low-resolution images, incorrect colours, wrong placement, or other issues that were visible before approval.

Production will only proceed after artwork confirmation, payment confirmation, or any other required approval.


5. Colour, Size and Printing Deviation

Customers acknowledge that printing and production may have reasonable variations.

Colour may appear different between screen display, digital proof, printed sample, and final production due to differences in monitor settings, material, printing method, ink, lighting, and production conditions.

Livera Gifts does not guarantee 100% colour matching unless specifically agreed in writing.

Possible production deviations may include but are not limited to:

  • Slight colour difference
  • Slight size difference
  • Slight cutting or sewing difference
  • Slight printing position difference
  • Slight material texture difference
  • Minor variation between batches or repeat orders

For custom products, a reasonable tolerance of approximately ±5% in colour, size, quantity, or finishing may apply depending on the product and printing method.


6. Quantity Variation

For certain custom, bulk, or printed products, the final delivered quantity may have minor over-run or under-run due to production process.

If there is a confirmed under-supply, Livera Gifts may at our discretion provide store credit, replacement, or pro-rated refund based on the missing quantity.


7. Lead Time and Delivery

Any production lead time, delivery date, or completion date provided is an estimate only.

Lead time may be affected by payment delay, artwork delay, customer approval delay, supplier delay, courier delay, stock availability, machine issue, public holidays, peak season, or other circumstances beyond our control.

Livera Gifts will make reasonable efforts to complete and deliver orders within the estimated time, but we shall not be liable for any loss, cost, or damages caused by delay.

Customers are responsible for providing accurate delivery details. Livera Gifts will not be responsible for delay, failed delivery, additional charges, or lost parcel caused by incorrect or incomplete delivery information.


8. Inspection Upon Delivery

Customers are required to inspect the goods immediately upon receiving them.

Any complaint regarding damaged goods, wrong items, printing defects, missing quantity, or other issues must be reported to Livera Gifts within 7 days from the delivery date.

Complaints submitted after 7 days may not be accepted.

For courier-related lost parcel claims, customers must notify us as soon as possible so that we may assist with checking with the courier company.


9. Cancellation, Return and Refund

Custom printed, personalised, made-to-order, or specially sourced products cannot be cancelled, returned, or refunded once production, printing, purchasing, or preparation has started.

If the customer cancels an order before production starts, Livera Gifts may at our discretion offer store credit or partial refund after deducting any cost already incurred.

Returned items will only be accepted if approved by Livera Gifts in writing.

Refunds, if approved, will be processed through the original payment method or bank account used for payment, subject to management approval.


10. Defective Products and Reprint

If a product is confirmed to be defective due to our production error, Livera Gifts may offer replacement, reprint, repair, store credit, or refund at our discretion.

To qualify for reprint or replacement, the customer may be required to return the full quantity of the defective goods in unused condition.

No artwork changes are allowed for reprint unless separately agreed.


11. Limitation of Liability

To the fullest extent permitted by law, Livera Gifts shall not be liable for any indirect loss, loss of profit, loss of business, loss of opportunity, loss of reputation, or consequential damages arising from use of the Website, product delay, delivery issue, printing variation, or order dispute.

Our liability, if any, shall be limited to replacement, repair, store credit, refund, or the amount paid for the affected product or service.


12. Intellectual Property

All content on the Website, including text, images, product photos, designs, graphics, logos, layout, and materials, belongs to Livera Gifts or the respective rightful owners.

You may not copy, reproduce, modify, distribute, or use any Website content without prior written permission from Livera Gifts.


13. Use of Customer Designs and Photos

Unless otherwise requested in writing, Livera Gifts may use photos of completed products, sample designs, or finished projects for portfolio, marketing, social media, advertising, and internal reference purposes.

If the customer does not wish for their product photos or designs to be used, they must notify Livera Gifts in writing.


14. Personal Data and Privacy

Livera Gifts may collect and use customer information for order processing, delivery, payment verification, customer service, marketing, account management, and business-related purposes.

Customer information may be shared with relevant service providers such as courier companies, payment providers, printing partners, or system providers where necessary to complete the order.

By using the Website and placing an order, you agree to the collection and use of your personal data for these purposes.


15. Inappropriate or Illegal Content

Livera Gifts reserves the right to reject or cancel any order containing content that we consider inappropriate, unlawful, offensive, harmful, pornographic, discriminatory, threatening, misleading, or infringing on third-party rights.


16. Website Availability and Errors

Livera Gifts does not guarantee that the Website will always be available, error-free, secure, or uninterrupted.

We are not responsible for any loss or inconvenience caused by Website downtime, technical error, system error, incorrect display, or unavailable features.


17. Changes to Terms and Conditions

Livera Gifts may update or amend these Terms and Conditions at any time without prior notice.

The latest version published on the Website shall apply.


18. Governing Law

These Terms and Conditions shall be governed by the laws of Malaysia.

Any dispute arising from the use of this Website, purchase of products, or engagement of services shall be subject to the jurisdiction of the courts of Malaysia.
